Supreme Court declares that vehicle assignation benefit has wage character

The labor substantive law considers any remuneration as salary, benefit or advantage, whatever its method of calculation, but it always has to be expressed in cash and payable to the worker for the rendering of their service and also that all the subsidies or facilities employer's initiative to obtain goods and services that improve their quality of life and that of his family, are also wages, with the only exclusions provided in the third paragraph of article 133 of the Labor Law, and applies the principle of the primacy of reality to any remuneration or advantage received by the rendering of service, regardless of the name the parties may give the perception, reiterating that wage should be in any case, assessable in money.
