Enabling Act that authorizes the President of the Bolivarian Republic of Venezuela to dictate decrees with the force of Law

This past Tuesday, November 19th of 2013, the Official Gazette Number 6.112, a decree granted by the National Assembly of the Bolivarian Republic of Venezuela was published containing the “Enabling Act that authorizes the President of the Bolivarian Republic of Venezuela to dictate decrees with the force of Law”, commonly known as Enabling Act.

The Content is composed of 4 articles, and among them they provide the authorization for the President of the Republic to dictate or reform laws and other legal instruments destined to strengthen the essential values in the exercise of public functions in order to guarantee and protect the interests of the State in its different levels of government, especially in the fight against corruption and the defense of the economy. All of this, in accordance with the last part of the article 203 and the numeral 8 of the article 236 of the Constitution of the Bolivarian Republic of Venezuela, which authorizes the President of the Republic with the Council of Ministries to dictate Decrees with the Force of Law.

The President was also authorized to dictate, among other laws, those destined to deepen and strengthen the penal, administrative, civil and disciplinarian sanctions to avoid the inadequate use of public funds, the illegal financing of political parties and combat money laundering, while avoiding capital flight, reforming the norms that determine the guidelines and strategies for the planning, articulation, organization and coordination of the procedures, especially in the productive sector, for the importation, distribution and marketing of foods, raw materials and articles of first necessity; as well as the norms dedicated to safe guarding the monetary stability of prices and the harmonious development of the economy by regulating the request for foreign currency to avoid their incorrect use and guarantee the right of the people to have goods and services at affordable prices.

The enabling of the President of the Republic to dictate or reform laws will have a time period of 12 months starting from the day it is published in the Official Gazette of the Bolivarian Republic of Venezuela.

In the frame of this enabling act, the “Law for the Protection of the People and their economic rights” was sent to the Supreme Court of Justice in order to give it the value of organic law, in accordance with the enabling act in its article 2 and article 203 of the Constitution of the Republic.

At the same time, the “Decree with Force of Law for the Creation of the National Center for Foreign Commerce and the Corporation of Foreign Commerce” was dictated.
